最高人民法院外事局、最高人民檢察院外事局、公安部外事局并海關(guān)總署緝私局：
中美雙方在《中美刑事司法協(xié)助協(xié)定》（見附件一）草簽時的“會談紀(jì)要”中曾就提取書證、證言和扣押物品作為證據(jù)的有效性進(jìn)行證明（即“證明表格”）事初步達(dá)成協(xié)議（見附件二）。
現(xiàn)在，中美雙方“中央機(jī)關(guān)”已經(jīng)就采用有關(guān)的書證證明表格和執(zhí)行活動證明程式的具體建議達(dá)成一致。為進(jìn)一步規(guī)范執(zhí)行刑事司法協(xié)助請求的程序并且使有關(guān)的執(zhí)行活動盡可能符合請求國法律提出的程序性要求，現(xiàn)就上述證明表格和證明程式在隨后辦理的中美刑事司法協(xié)助案件中采用之事通知如下：
1． 當(dāng)我國公安機(jī)關(guān)、走私犯罪偵查機(jī)關(guān)、檢察機(jī)關(guān)、審判機(jī)關(guān)為辦理涉美刑事案件而依據(jù)《中美刑事司法協(xié)助協(xié)定》向美方提出關(guān)于代為詢問證人、提取書證或者扣押物品的請求時，我司作為中方“中央機(jī)關(guān)”的職能部門將自動在請求書中注明關(guān)于依照附件三1、2或者3列舉的證明項目和程式制作有關(guān)文書的要求，并將上述有關(guān)證明格式附于我向美提出的請求書后。鑒此，我有關(guān)司法機(jī)關(guān)在向我司轉(zhuǎn)交請求材料時，可不再隨附上述表格。如果我方提出請求的機(jī)關(guān)認(rèn)為需要在有關(guān)的證明程式中增加新的內(nèi)容，應(yīng)當(dāng)在向我司提交的請求材料中做特別說明。
2． 當(dāng)美方依據(jù)《中美刑事司法協(xié)助協(xié)定》向我方提出關(guān)于調(diào)取業(yè)務(wù)記錄、調(diào)取公文書記錄或者扣押物品的請求時，作為美方“中央機(jī)關(guān)”的美國司法部將在有關(guān)請求書中注明關(guān)于填寫附件三4、5或者6表格的要求，我司在向我國執(zhí)行機(jī)關(guān)轉(zhuǎn)遞請求材料時隨轉(zhuǎn)有關(guān)的證明表格中文本。請各執(zhí)行機(jī)關(guān)在執(zhí)行有關(guān)請求時注意按要求用中文填寫所附表格。如果美方提出使用英文填寫有關(guān)表格的特殊要求，將由我司負(fù)責(zé)按照中方執(zhí)行機(jī)關(guān)填寫的證明表格中文本進(jìn)行翻譯。
3． 如果我國提出協(xié)助請求的機(jī)關(guān)發(fā)現(xiàn)美方提供的執(zhí)行結(jié)果未按要求履行有關(guān)的證明程式，可以通過我司要求美方予以補(bǔ)充。如果我國執(zhí)行協(xié)助請求的機(jī)關(guān)未按要求填寫有關(guān)的證明表格，我司將通知該執(zhí)行機(jī)關(guān)予以補(bǔ)充。
4． 在特殊情況下，如果我國執(zhí)行機(jī)關(guān)認(rèn)為不能使用美方要求填寫的證明表格，應(yīng)當(dāng)及時向我司說明情況，以便我司在答復(fù)請求時作出解釋或者由我司根據(jù)《中美刑事司法協(xié)助協(xié)定》的規(guī)定對有關(guān)材料做附加證明。
5． 在執(zhí)行美方的有關(guān)協(xié)助請求時，如果美方提供的表格份數(shù)不夠，相關(guān)的執(zhí)行機(jī)關(guān)可以按照本通知附件的樣式根據(jù)需要復(fù)制有關(guān)的證明表格。

關(guān)于提取書證的要求
（當(dāng)中方是請求方時）
在答復(fù)中方提出的提取書證的協(xié)助請求時，美方須出具：
一、提取過程記錄，包括以下內(nèi)容：
1．所提取的文件在何單位、由何人保管；
2．文件是原件還是復(fù)印件；
3．提取的時間及地點(diǎn)；
4．提取文件的執(zhí)法或司法機(jī)構(gòu)蓋章或由至少兩名提取文件的執(zhí)法或司法人員簽名。
二、認(rèn)證，包括以下內(nèi)容：
1．經(jīng)提供文件的文件保管人簽名的聲明，寫明：“我叫______，我知道，如果我故意作出不真實陳述，將有可能依照美國法律負(fù)刑事責(zé)任；謹(jǐn)聲明，此文件是原件（或原件的復(fù)印件）”；
2．提取文件（原件或復(fù)印件）的執(zhí)法或司法人員簽名并注明取證的日期；
3．就原件而言，認(rèn)證應(yīng)在原件以外另附單頁；就復(fù)印件而言，認(rèn)證應(yīng)做在文件的最后一頁上。

When PRC is Requesting Party Requirements for Assistance in Taking Documentary Evidence
In response to a Chinese request for assistance in taking documentary evidence，the U．S．side shall provide the following：
Chinese side with a verbatim transcript of the questioning which shall meet the following requirements：
1．Record of the evidence-taking procedure，which will include：
a．Entity from which the document is sought and the custodian；
b．Whether the document is original or a copy；
c．Date and place evidence was taken；and
d．Seal of the law enforcement or judicial organ which performs the evidence taking or signature of at least two law enforcement or judicial officers who take the evidence；and
2．Authentication，which shall include：
a．A signed statement by the custodian from whom the document is sought as follows：“I，______，knowing that I will be subject to criminal liability under the laws of the United States if I intentionally make a false statement，declare that this document is an original（or a copy of the original）”；and
b．The signature of the law enforcement or judicial officer who takes the document（original or copy）and the date of the collection of the evidence．
C．For original documents，authentication shall be made on a separate piece of paper accompanying the original documents．For copies，the authentication shall be made on the last page of the document．

關(guān)于代為詢問證人的要求

在答復(fù)中方提出的代為詢問證人協(xié)助請求時，美方須向中方提供“詢問筆錄”，并須滿足以下要求：
一、筆錄應(yīng)包括：
1．根據(jù)中方提供的詢問提綱所進(jìn)行的詢問的詳細(xì)記錄；
2．詢問的時間、地點(diǎn)、被詢問人的基本情況、住所及電話號碼；
3．進(jìn)行詢問的執(zhí)法或司法人員簽名并注明日期。
二、詢問需要由執(zhí)法或司法人員二人以上進(jìn)行，并注明執(zhí)法或司法人員的所屬部門及職務(wù)
；
三、詢問人須向被詢問人告知其權(quán)利及如果在宣誓情況下故意作出不真實陳述應(yīng)負(fù)的刑事責(zé)任
；
四、在詢問筆錄的結(jié)尾處，要求被詢問人寫明：“以上記錄給我看過，與我所講的一致”的字樣，并由被詢問人簽名并注明日期；如被詢問人拒絕作上述聲明，詢問人應(yīng)寫明，已向該人提出上述要求，但被該人拒絕，并由詢問人簽名并注明日期。

When PRC is Requesting Party Requirements for Assistance in Taking Testimony
In response to a Chinese request for assistance in taking testimony，the U．S．side shall provide the Chinese side with a verbatim transcript of the questioning which shall meet the following requirements：
1．The transcript shall
a．provide a detailed record of the questioning conducted in accordance with the questions provided by the Chinese side，
b．state the time and place of the questioning，basic condition of the questioned person and his or her address and telephone number，and
c．signature of the law enforcement or judicial officers who do the questioning，with the date．
2．Questioning shall be conducted by at least two law enforcement or judicial officers with their department and positions identified；
3．The questioner shall make clear to the questioned person his（or her）rights and criminal liability for an intentional false statement given under oath；
4．The questioned person shall be requested to provide a statement at the end of the transcript along the following lines：“I have read the above transcript，which is in conformity with what I have said”with his（or her）signature and the date．If the person declines the request for such a statement，the questioner shall provide a signed and dated statement that the request was made and that the questioned person declined to provide it．

關(guān)于扣押物品的要求
（當(dāng)中方是請求方時）
在答復(fù)中方提出的扣押在美國境內(nèi)的物證或物品的協(xié)助請求時，美方提供給中方的答復(fù)文件中應(yīng)包括以下內(nèi)容：
一、扣押物品過程的記錄
1．所扣押物品在何單位、由何人保管；
2．所扣押物品的特征、客觀狀態(tài)（大小、形狀、顏色等）、數(shù)量等的描述；
3．扣押的時間、地點(diǎn)；
4．物品持有人（或保管人）簽名；
5．執(zhí)行扣押的執(zhí)法或司法機(jī)關(guān)蓋章（或由執(zhí)行扣押的執(zhí)法或司法人員簽名）并注明日期。
二、被扣押物品的全貌及細(xì)目照片3-5張。
三、認(rèn)證，須由執(zhí)行扣押的執(zhí)法或司法人員在被扣押物品照片背面寫有：“此照片系所扣押物品的照片”的字樣，并由其簽名并注明日期。

When PRC is Requesting Party Requirements for Assistance with Respect of Seized Items
In response to a Chinese request for assistance with respect of the seizure of material evidence or articles located in the U．S．，the following elements shall be included：
1．Record of items’seizure procedure：
a．Entity where the items are seized and the custodian；
b．Description of features，objective state（size，shape，color），and quantity of the seized items；
c．Date and place of the seizure；
d．Signature of the custodian（or who holds it）；and
e．Seal of the law enforcement or judicial organ which executes the seizure（or the signature of the law enforcement or judicial officers who perform the seizure）and date．
2．Three to five pictures of the entire or parts of the seized article．
3．Authentication shall be accomplished by the law enforcement or judicial officers who perform the seizure writing at the back of the picture such language as“this is the picture of the seized items”with their signature and date．
